These Terms of Use ("Terms") govern access to and use of the website located at marketflux.life (the "Site") operated by MarketFlux Pte. Ltd. ("MarketFlux", "we", "us"), UEN 202542096H. By accessing the Site, you agree to these Terms. If you do not agree, do not use the Site.
1. About MarketFlux
MarketFlux is a performance and content marketing agency registered in Singapore. We provide paid media management, content marketing, creative production, conversion optimisation, and analytics services to business clients under separate written agreements. The Site is an informational and enquiry channel — not a trading platform, investment service, software product, or coaching programme.
2. No professional or financial advice
Content on the Site is for general information only. Nothing on the Site constitutes financial, investment, legal, or tax advice. Case studies and metrics describe past engagements under specific conditions and are not forecasts or guarantees of future performance. Marketing outcomes depend on many factors outside our control. Do not make business or investment decisions based solely on Site content.
3. Permitted use
You may access the Site for lawful personal or internal business purposes. You agree not to:
- Use the Site in violation of applicable law or third-party rights;
- Attempt unauthorised access to our systems, accounts, or networks;
- Introduce malware, scrape content at scale, or interfere with Site operation;
- Misrepresent affiliation with MarketFlux;
- Use contact forms or email addresses for spam, solicitation unrelated to our services, or abusive communications;
- Reproduce, distribute, or create derivative works from Site content without prior written consent except as permitted by fair dealing or similar exceptions under Singapore law.
4. Intellectual property
All text, graphics, logos, layout, and software on the Site are owned by MarketFlux or licensed to us and protected by copyright, trademark, and other intellectual property laws. "MarketFlux" and associated branding may not be used without permission. Client work displayed with permission remains subject to separate ownership terms in client contracts.
5. Enquiries and forms
Submitting a contact form does not create a client relationship or oblige MarketFlux to provide services. We may decline engagements at our discretion. Information you submit must be accurate. You must not submit confidential third-party information without authority. Form processing is described in our Privacy Policy.
6. Third-party links and platforms
The Site may link to third-party websites or reference advertising platforms (Google, Meta, TikTok, LinkedIn, etc.). We do not control third-party sites and are not responsible for their content, policies, or availability. Platform names and trademarks belong to their respective owners.
7. Disclaimers
The Site and its content are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement, to the fullest extent permitted by Singapore law. We do not warrant uninterrupted or error-free operation.
8. Limitation of liability
To the maximum extent permitted by law, MarketFlux and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from use of the Site. Our aggregate liability for claims relating to the Site shall not exceed SGD 100. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
9. Indemnity
You agree to indemnify and hold harmless MarketFlux from claims, damages, and expenses (including reasonable legal fees) arising from your breach of these Terms or misuse of the Site, except where caused by our gross negligence or wilful misconduct.
10. Service contracts
If you become a client, the terms of your statement of work, master services agreement, or retainer contract prevail over these Terms for service delivery, fees, confidentiality, intellectual property in deliverables, and performance obligations. These Terms continue to govern Site use.
11. Changes
We may modify these Terms at any time by posting updated text on this page with a revised date. Material changes may additionally be communicated where appropriate. Continued use after changes constitutes acceptance.
12. Governing law and jurisdiction
These Terms are governed by the laws of Singapore. You submit to the exclusive jurisdiction of the courts of Singapore for disputes arising from or relating to the Site, subject to any mandatory consumer protections that apply to you.
13. Severability
If any provision is held invalid or unenforceable, the remaining provisions remain in effect.

15. Entire agreement for Site use
These Terms, together with the Privacy Policy and Cookie Policy linked from the Site, constitute the entire agreement between you and MarketFlux regarding use of marketflux.life, superseding prior oral or written understandings on that subject. No waiver of any Term shall be effective unless in writing signed by MarketFlux.
16. Assignment
You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations in connection with a merger, acquisition, or sale of assets, provided the assignee agrees to honour these Terms.
17. Feedback
If you submit suggestions, ideas, or feedback about the Site or our services, you grant MarketFlux a non-exclusive, royalty-free, perpetual licence to use that feedback for any purpose without obligation to you, except where prohibited by law or covered by a separate confidentiality agreement.
18. Force majeure
MarketFlux is not liable for failure or delay in Site availability resulting from events beyond reasonable control, including natural disasters, power failures, internet outages, government actions, or platform-wide advertising system disruptions.
19. Language
These Terms are written in English. If translated for convenience, the English version prevails in case of inconsistency.
20. Survival
Provisions that by nature should survive termination of Site access — including intellectual property, disclaimers, limitation of liability, indemnity, and governing law — remain in effect after you stop using the Site.
21. Electronic communications
By using the Site or submitting forms, you consent to receive communications from us electronically. You agree that electronic notices satisfy any legal requirement that such communications be in writing where permitted under Singapore law. We may also post notices on the Site homepage when appropriate.
